Terms of Service – Rosie Miller Hand‑Made Furniture
(Effective 1 October 2025 – please read carefully before placing an order)
1. Introduction
These Terms of Service (“Terms”) govern the relationship between Rosie Miller (“Designer”, “Artist”, “we”, “us”) and any individual or entity (“Customer”, “you”) who purchases hand‑made furniture (“Products”) directly from the Rosie Miller Collection. By placing an order, requesting a quote, or otherwise engaging with us, you agree to be bound by these Terms. If you do not accept them, do not place an order.
2. Nature of the Products
Artist‑Made, Not Mass‑Produced – Every piece is conceived, sculpted, and constructed by Rosie Miller as a unique work of art. Items are hand‑crafted, not machine‑cut, and are not produced in bulk.
Sculptural Approach – The Designer treats each item as a sculpture rather than a showroom commodity. Consequently, minor variations in texture, grain visibility, or finish are expected and embraced as part of the artistic process.
3. Quotations & Acceptance
Quote Issuance – Upon request, we will provide a written quotation outlining product specifications, price, estimated lead time, and any applicable taxes or shipping fees.
Acceptance – Your written confirmation (email or signed document) constitutes acceptance of the quote and triggers the creation of an invoice.
4. Payment
Payment Timing – Full payment is required at the time of ordering (i.e., upon receipt of the invoice). Accepted payment methods will be indicated on the invoice.
Non‑Refundable – Once payment is received and the order is entered into our production schedule, the transaction is non‑refundable. No cancellations, returns, or exchanges are permitted, except as expressly provided in Section 9 (Defects).
5. Production Schedule & Delivery
Scheduling – After payment, your item is added to the production queue. We will provide an estimated completion date in the invoice; this estimate is based on current workload and material availability.
Delivery – Shipping arrangements, costs, and timelines will be communicated at the time of order. Delivery dates are estimates only; we are not liable for delays caused by carriers, customs, weather, or force‑majeure events.
6. Ownership & Intellectual Property
Design Rights – All designs, sketches, and artistic concepts remain the exclusive intellectual property of Rosie Miller.
Limited License – Purchase grants you a non‑exclusive, worldwide right to use, display, and resell the specific physical item you receive. You may not reproduce, copy, or distribute the design itself.
7. Warranty & Defects
Craftsmanship Warranty – We warrant that each product will be free from defects in materials and workmanship for 30 days from the date of delivery.
Claim Procedure – To make a claim, you must notify us in writing within the warranty period, providing photographic evidence of the defect. We will, at our discretion, repair or replace the item. This warranty does not cover normal wear, damage caused by misuse, improper handling, or alterations made after delivery.
8. Limitation of Liability
To the fullest extent permitted by law, Rosie Miller shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to the purchase, use, or inability to use the Products, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid for the specific Product in question.
9. Force Majeure
Rosie Miller shall not be responsible for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, strikes, civil unrest, or interruptions in supply chains. In such events, we will notify you promptly and may adjust delivery dates accordingly.
10. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Queensland, Australia. Any dispute arising under or relating to these Terms shall be resolved first through good‑faith negotiation. If unresolved, the parties agree to submit the dispute to mediation administered by an agreed‑upon mediator. Failing mediation, the dispute will be brought before the courts of Queensland.
11. Amendments
We reserve the right to amend these Terms at any time. Any changes will be posted on our website and will apply to orders placed after the amendment date. Existing orders will continue under the version of the Terms that was in effect at the time of order acceptance.
